will be done for those responsible forked murders of four americans in libya. i'm larry beil in for dan ashley tonight. tensions running high across the middle east as protesters continue to clash with police/video just in from cairo, ediplomat near the u.s. embassy. the u.s. is sending two warships in to libya in response to the attacks that killed a bay area u.s. diplomat along with three others. among the dead, ambassador christopher stevens. he went to high school and college in the bay area and was appointed to that post in libya within the last few months. heather ishimaru with a look at steven's life. >> my name is chris stevens and i'm the new u.s. ambassador to libya. >> reporter: chris stevens made this video to introduce himself to the people of libya. friends and family described him as a natural diplomat. a dream ambassador, knowledgeable, experienced and quietly unpreten showers.

>> the world needs more of these guys not fewer and i think it is why he was so good at his job because he was always trying to find ways to find common ground between people. >> this was something completely unexpected considering how well liked the a.m. was door -- ambassador was in libya and how effective he had been. >> he was fluent in arabic. >> one of the things that impressed me when i was last in libya was listening to the stories from the people who were old enough to study and travel in the united states back when we had closer relations. those days are back. >> he was a history major at cal and a 1989 graduate of hastings. one of his professors was still in touch with him yes. >> went to go save his own

people. he could have sent the marines or staff mens to the consultate. he didn't have to go in there and he chose to go in there to try and save his people. seems that is just the epitome of what chris was all about in the foreign service. >> a 1978 graduate of piedmont high school where he was in the model u.n. and active in the theater department. he loved tennis and running and his friends. >> even after he had been appointed to the ambassador he was still on facebook, still making jokes and stillle staying in touch with people. he never ever lost the ability to just reach out to people and be great. >> stevens brother says chris never married. he spent the final weeks of his life attending a friend's wedding in sweden and then stopped off in vienna for good triple crowns and museums before returning to libya to get back to work. heather ishimaru, abc 7 news. live at uc berkeley tonight

a candle light vigil is just getting underway. >> if you take a look behind me i'm he at the fraternity house at cal and the candle light vigil started just a few moments ago. you can see the brothers out here honoring and remembering their fallen brother, u.s. ambassador to libya chris if he steven. we have more of the introduction video he made to introduce himself to the the people of libya. i spoke with a friend who says he was always positive and just really wanted to help the people there. i spoke to his step father who says it was a privilege to have been his step father for 36 years. he says despite the risk, stevens is right where he wanted to be. >> i would have thought he wanted a more cushy career in a more exotic and comfortable place but he believed in doing that and working for the democracy and for an improvement of that society and

so it came back to kill him. >> reporter: and president obama called the family tonight and his step father says he was freshtive of that and the president spoke as if he had lost a colleague, not as if he was reading any sort of script so he was very purchasetive of that. the vigil should go on for a half hour. they are are expecting some alumnus to come by and receive and talk about their fallen brother. iville more tonight on abc 7 news at 11:00. in berkeley, abc 7 new its. we will see you at 11:00. initial reports indicated the attack in libya was in retaliation for a movie trailer that made fun of islam and the prophet muhammad. u.s. government officials are saying there is evidence this was a planned terrorist attack. mark matthews has the reaction. >> reporter: the attack that

killed ambassador stevens and three other american diplomats was carried out on september 11th by a group of three men firing automatic weapons and firing rocket propelled grenades. >> it is not simply a threat to the koran. that sometimes will provoke a street demonstration but the actual terrorist attacks are better planned and i'm sure this was planned for awhile. >> reporter: tom hendrickson believes u.s. foreign policy towards libya may have played a part. >> there has been a til tendency upon the administration and the american people which administration reflects to think we can leave the middle east to its own devices and we can somehow not intervene in libya, leave it go, not be engaged in certain parts of the world. >> hendrickson points to the u.s. withdrawal from iraq but that criticism confound's canada's former ambassador to the european union. >> i don't find the criticism in the slightest warranted.

a big construction dig revealed something amazing in san francisco that is now drawing the attention of paleontologists. the discovery was made by crews working on the new you transbay terminal project at first street between mission and howard. carolinas carolinas has the willie ma moth details. >> it started at just another day for crane operator brandon. >> i excavating using a hammer grab and going through a layer of sand and suddenly i notice some strange object that came out. >> reporter: this is what he had pulled up from 110 feet below the surface. the tooth and part of a jaw of a woolie ma math considered the most famous of the prehistoric mammals. cousin of the modern day elephant. >> this bay stuff is the original enamel preserved along

streets and the word gets out and more are and more people are rushing into the streets to try to scoop up the money. the chase began at a bank in santa clarita and ended downtown when another suv driver cut the people off. the thieves off. it is not clear whether the driver cut them off on purpose. in ohio, a driver in a real h hurry takes a bizarre shortcut. the woman driving this car didn't want to wait for the school bus so drove on to the sidewalk to get around it. >> what! >> the bus driver says this happens every day. so this time he grabbed his cell phone and shot video of the woman beating past the sidewalk. police caught up with her and gave her a ticket for not stopping behind the bus. >> that is truly -- >> people are are out the control. >> totally out of control! >> gosh. >> you are under control, spencer christian. >> unless i see a wooly mammoth then i will be out of control. >> then we are both out of

mcdonalds adding a new item to its menus. calorie counts. they will start posting them on the restaurant menus. they are making the change as it tests out healthier items. the company is testing an egg mcmuffin made with egg whites and a whole grain muffin. and mcdonald's will also offer more seasonal fruits and vegetables. heidi coliseum appeared on katy he couric's new talk though which airs on abc 7. she admitted she is dating her body guard now but said she did not have an affair with him while still married to seal. seal says he accused her of starting the relationship before they were ever separate. >> i never looked at another man while i was with him and it

california's sweeping new pension reforms are law tonight. in los angeles today, governor brown signed a measure increasing the co--pay for new state employees benefits, reducing their retirement benefits and raising the age at which they can receive them. >> we are going to get people working longer. we are going to cap the amount. you you shouldn't be getting a pension when you make the bigger salaries like some of the managers do. the more money you make you are supposed to know how to invest it yourself. >> the reform bill caps pensions at $132,000 a year. the state's public pension funds are underfunded to the tune of $165 billion. the reforms are expected to save as much as $55 billion over the next 30 years. a controversial proposition on the november ballot is designed to bring in more money for california. critics say this could backfire and cause the state to lose money and jobs. capital correspondent nannette

miranda has the story. >> reporter: venture capitalist tom styer is trying to cement california's standing as the country's green leader by spear heading proposition 39 on the november ballot but how he wants to pay for the clean energy effort is controversial. take away what he calls a loophole allowing multistate corporations to it choose between two formulas when calculating state tax. was part of a late night deal in 2009 to entice republicans vote for the state budget. since then companies have chosen the farm la that means less money for the state. >> it is crazy to do that and we can't afford to give away over a billion dollars a year to companies from out of state. detroit automakers for example have a smaller state tax bail. fewer employees here but big sales of their products in california. some california companies like genentech say that is not fair. the bay area biotech firm decided to open an offense in

oregon to take advantage of the tax break. prop 39 stops rewarding companies for creating jobs out of state. with the billion dollars a year half of it will help retrofit public buildings for alternative energy for five years and help train a workforce to do the projects and the other half goes to the state budget to help schools. >> it brings over a billion dollars to the state every single year and the way it is constructed itle create tens of thousands, up to a hundred thousand jobs. >> multistate companies say changing the tax formula will actually cost california jobs. >> it will raise the cost of doing business in the state and that will hurt jobs. >> with no formal campaign launched to fight prop 39 it will be difficult to reach out to voters. >> it is hard to understand whatcom lexitys of corporate complexities really are and if you don't understand it you

should probably vote know. >> styer does admit that he invests in green tech companies but insists thisle not boost his portfolio. in sacramento, nannette miranda, abc 7 news. the city of hercules is still reeling over the way public money was spent by those running city hall. many of the politicians are now gone but today a new state audit sheds light on the city's questionable spending and accounting practices. news reporter nick smith has details. >> it is frustrating for us. >> reporter: craig stokes like most small business owners is careful to watch every penny he makes. >> a real hard couple of years from the second and third year in. >> that is why the findings of two state audits calling into question $50 million to redevelopment funds is frustrating. the mismanagement by city leaders almost pushed her are cue lease over a financial cliff, taking craig and his business along with it.

progress. a cal trans audit performed showed that the state was is capable of handling state and if federal funds in excess of 10 million today's fund a new amtrak station. >> today they would be able to find everything and see we are doing things the way we should be doing. >> the new city council has even won community support at the ballot box. 70% of voters approved a half cent sales tax expected to generate thousands of dollars in new revenue taking them on the path to fiscal solvency. a superior court judge has cleared the way for a tougher ban on plastic bags in san francisco. aerology late today upheld the new ordinance that expands the existing ban to all stores and restaurants. it takes effect at retail stores on october 1. the new ban will be impalemented in restaurants by next july. the decision came after plastic bag manufacturers tried to block the law. retailers will now charge 10

for years yew have been able to buy things online without paying sales tax. the honeymoon ends this weekend. after a drawn out battle with lawmakers amazon.com will collect a sales tax starting saturday. until then, a lot of people are cramming in last minute tax free shopping.

obviousry a tough challenge against a good run defense. so we got to be on our game. >> their front is very good either way. they have given people fits in the preseason and last week. got some really good pass rush and a good job against the run. just a very solid group. definitely the strength in their defense. >> the nfl network coming to abc 7 on thursday, october 18 and niners host seattle and then we have the raiders on thursday night as well and they host denver on december 6. the cal bears quite a schedule the next two weeks starting off in ohio to face the 12th ranked buckeyes of ohio state on saturday. the final week before they hit the pac 12 portion of their schedule. they have is not faced ohio state since 1972 and their quarterback understands the importance of this weekend's game style of cooking huge tradition. everybody knows ohio state and was raised watching those type of guys play.

it is a huge game for us and big game as well as the week after following up with usc. next game is the most important game so no matter who we are playing we are going to play the game like it is the biggest game of our lives. >> notre dame leaving the big east, jumping to the the acc conference in 2014 for all sports except football but they will remain independent but play five acc teams. the $7.5 million exit fee is forthcoming to the big east and i think they are a little afraid to face, florida state. >> what is going to be funny with the lions niners game. everybody will be rivetted for the end of the game when schwartz and harbaugh get together and see what is going to happen there. >> or maybe the beginning to see if they communicate ahead of time. >> there is not going to be a lot of talking before the game between those two. that is a wrap for us. for all of us here at abc 7
